IT IS ABOUT COMPLIANCE, SPECIFICALLY THE CITY COUNCIL OBLIGATION UNDER FEDERAL AVIATION LAW AND THE SPONSOR OF A FEDERALLY FUNDED AIRPORT.
THE AGENDA ITEMS TONIGHT, SIX AND SEVEN CONCERNING LEASE AMENDMENTS GO DIRECTLY TO THE HEART OF THIS DISCRIMINATION.
UH, I'VE RAISED IN MY PART 16 COMPLAINT.
I'VE OPERATED IN AND OUT OF THIS AIRPORT, THE GRAND PRAIRIE AIRPORT, AND HAVE TAKEN EXTENSIVE STEPS TO COMPLY WITH SAFETY RULES, OPERATIONAL REQUIREMENTS, AND FEDERAL AVIATION REGULATIONS.
THE ISSUE BEFORE YOU IS CERTAIN REQUIREMENTS OF THE PARTICULAR MINIMUM STANDARDS RELATED TO OFFICE SPACE AND LEASE CLASSIFICATIONS ARE BEING APPLIED IN A WAY THAT CREATES UNREASONABLE AND DISCRIMINATORY BARRIERS TO OPERATION.
THESE ARE NOT FAA SAFETY REQUIREMENTS.
THEY'RE LOCAL RULES THAT STILL MUST COMPLY WITH FEDERAL LAW.
AS YOU KNOW, AIRPORTS, AIRPORTS THAT ACCEPT FEDERAL GRANT FUNDS MUST COMPLY WITH FEDERAL GRANT ASSURANCES, INCLUDING ECONOMIC NON-DISCRIMINATION AND THE PROHIBITION OF EXCLUSIVE RIGHTS.
THE FA A'S OWN GUIDANCE IS CLEAR.

OVER MANY MONTHS, I HAVE ATTEMPTED TO RESOLVE THESE MATTERS DIRECTLY WITH THE AIRPORT MANAGEMENT.
INSTEAD OF COLLABORATIVE COMPLIANCE DISCUSSIONS, I WAS DIRECTED TO SIMPLY COMPLY WITH THE REQUIREMENTS.
AND I BELIEVE THEY'RE NOT ALIGNED WITH FA, A POLICY WITHOUT

AND BECAUSE CITY COUNCIL ULTIMATELY OVERSEES THE AIRPORT, I WAS ADVISED TO JUST WORK IT OUT RESPECTFULLY.
THAT RESPONSE MATTERS BECAUSE IT EXPLAINS EXACTLY WHY THIS ISSUE HAS ESCALATED.
WHEN MANAGEMENT DECLINES TO ENGAGE AND ELECTED OVERSIGHT DEFERS ENTIRELY, THERE IS NO LOCAL REMEDY.
I WANNA BE CLEAR, THIS IS NOT ABOUT PERSONALITIES.
THIS IS ABOUT PROCESSING COMPLIANCE.
I'M ASKING THE CITY TO WORK TOWARDS AN ALIGNMENT WITH FEDERAL REQ, UH, REG REQUIREMENTS, NOT ENFORCE ARBITRARY LOCAL RULES THAT MAY PLACE THE CITY AT RISK.
I WANT TO CLARIFY ONE IMPORTANT PROCEDURAL POINT.
AFTER EXHAUSTING ALL LOCAL EFFORTS, I HAVE FILED A FORMAL COMPLAINT WITH THE FEDERAL AVIATION ADMINISTRATION UNDER WHAT IS CALLED A PART 16.
PROCEEDING A PART 16 IS NOT A LAWSUIT.
IT IS THE FA A'S ADMINISTRATIVE COMPLIANCE USED WHEN AN AIRPORT HAS ACCEPTED FEDERAL FUNDING AND MAY NOT MEET ITS GRANT OBLIGATIONS, THIS PROCESS FOCUSES ON CURRENT COMPLIANCE AND GIVE THE AIRPORT SPONSOR AN OPPORTUNITY TO CORRECT THESE ISSUES.
WHILE THE FAA EVALUATES WHETHER OR NOT LOCAL RULES ALIGN WITH FEDERAL REQUIREMENTS AT THE SAME TIME, IN PARALLEL, NOT IN CONFLICT, I HAVE SUBMITTED WRITTEN REQUESTS TO THE AIRPORT DIRECTOR AND THE CITY ATTORNEY SEEKING INTERIM OPERATING AUTHORIZATION AND APPROVAL TO SUBLEASE PRIVATELY OWNED AIRPORT PORTA PORT HANGERS.
ON IDENTICAL TERMS IN PRIOR LEASES, THESE REQUESTS WERE MADE SPECIFICALLY SO THE OPERATIONS CAN CONTINUE IN A LAWFUL WAY WHILE THE CITY WORKS THROUGH THE MINIMUM STANDARDS AND LEASE CLASSIFICATIONS IN COMPLIANCE WITH BOTH TEXAS LAW AND FEDERAL REQUIREMENTS, THESE STEPS WERE TAKEN DELIBERATELY AND IN GOOD FAITH.
THEY ARE INTENDED TO PRESERVE SAFETY AND PROTECT THE CITY, WHILE ALLOW TIME FOR COMPLIANCE TO BE ACHIEVED WITHOUT UNNECESSARY DISRUPTION.
MY PREFERENCE REMAINS LOCAL RESOLUTION.
THE PART 16 FILING ONLY EXISTS BECAUSE THERE WAS NO REMAINING LOCAL PROCESSES AVAILABLE, NOT BECAUSE LITIGATION IS THE GOAL.

UH, THEY HAVE COME BACK TO THE CITY TO REQUEST AN ADDITIONAL 69.27295 ACRES,

UM, WE WOULD BECOME AN UNLEASED MINERAL OWNER.
UM, IF WE WERE TO BECOME AN UNLEASED MINERAL OWNER, WE WOULD NOT RECEIVE ANY LEASE BONUS PAYMENTS.
UM, AND WE WOULD EXPECT DELAYED ROYALTIES UNTIL AFTER THE OPERATOR RECOVERS ALL THE DRILLING AND COMPLETION COSTS.
SO ONE OF THE CONSIDERATIONS IS WHAT IS THE MARKET VALUE FOR, UH, BONUS LEASES AND FOR, UH, ROYALTIES, UM, IN THE MARKET NOW, IN THE BARNETT SHALE, WE'RE LOOKING AT 50 TO $500 PER LEASE ACRE AND ANYWHERE FROM 16.67 TO 20% ON ROYALTIES.
OUR OFFER UNDER THIS LEASE IS THE SAME AS IT WAS UNDER THE PREVIOUS LEASE.
UM, THE ONE WE'RE GOING TO AMEND, UM, WHICH IS 500 PER ACRE AND 25%.
AND WITH THAT, I WILL TAKE ANY QUESTIONS.
UM, QUESTION, UM, REGARDING, THERE'S BEEN QUESTIONS REGARDING, UM, DR. JORDAN WHEELS IN GENERAL, LIKE, UH, INSPECTIONS.
HOW OFTEN INSPECTED, WHAT'S THE CITY'S ROLE, UH, WITH THE PAD SITES THAT ARE IN, WITHIN OUR CITY LIMITS? RIGHT.
SO, UM, FOR THIS LEASE HERE, UM, THERE IS ONE GRAND PRAIRIE, UH, PAD SITE INVOLVED THAT'S ALREADY AN ACTIVE, UM, PRODUCTION SITE.
AND THEN TWO OF THE SITES ARE IN ARLINGTON, UH, IN GRAND PRAIRIE.
WE HAVE AN INSPECTOR WHO INSPECTS ALL GAS WELL PAD SITES DURING DRILLING, FRACTURING, UM, AND PRODUCTION.
AND WE ALSO HAVE A THIRD PARTY GAS WELL INSPECTOR WHO DOES SOME ADDITIONAL TESTING, UH, FOR AIR EMISSIONS.
UM, SO THESE SITES ARE VERY WELL REGULATED.
ARLINGTON HAS A COMPARABLE PROGRAM AND, UM, NONE OF THESE, UH, MINERAL LEASES ARE DEAL WITH ANY KIND OF SURFACE AGREEMENTS.
SO THEY WOULD COME OFF OF PAD SITES THAT ARE ALREADY ESTABLISHED AND IN COMPLIANCE WITH BOTH THE CITIES OF ARLINGTON AND GRAND PRAIRIE AND THE RAILROAD COMMISSION.
AND, AND, AND I GUESS IF THERE'S ANY QUESTIONS THAT RESIDENTS MIGHT HAVE, LIKE THERE'S DRILLING GOING ON AND THEY HAVE QUESTIONS, THEY EITHER SPILL AN ORDER OR THEY, THEY SEE SOMETHING THAT DOESN'T LOOK RIGHT TO THEM.

THE TOTAL PROGRAM IS GOING TO BE APPROXIMATELY TWO, UH, $327 MILLION, PRESENTED AS THREE SEPARATE PROPOSITIONS ON THE BALLOT.

UM, AND THEN IT'S TUCKED BEHIND THIS LARGE 400,000 SQUARE FOOT BUILDING, WHICH ACTS AS AN IMPORTANT VISUAL BUFFER AS WELL AS NOISE MID LITIGANT.
UM, IF WE DIG INTO THE OUTSIDE STORAGE AREA ITSELF, THESE PHOTOS WERE TAKEN, AT LEAST THE PHOTO ON THE RIGHT WAS TAKEN TODAY.
SO THIS IS WHAT IT LOOKS LIKE TODAY.
UM, SO THESE ARE THE RACKS ON THE LEFT WHERE WE HAVE THESE PARTS THAT ARE BROUGHT IN FROM GM OR TESLA AND THEN MOVED INTO THE BUILDING.
THESE RACKS ARE SH SHORTER THAN THE BUILDING ITSELF, SO YOU CANNOT SEE THEM OVER THE BUILDING.

AND THEN WE ARE, WE ARE NOT ALLOWED PER THE SUP TO STACK ALONG THAT CHAIN LINK FENCE.
UM, AND THEN ALONG THAT CHAIN LINK FENCE IS WHERE WE ARE PROPOSING THE POLYETHYLENE SLATS TO MAKE THAT CHAIN LINK FENCE OPAQUE.
UM, IF WE COULD MOVE THOSE RACKS INSIDE, WE WOULD DO IT, BUT THERE IS NO SPACE, THERE'S NO WAY TO BRING THOSE INSIDE AND MEET OSHA REQUIREMENTS AND ENSURE THE SAFETY OF OUR EMPLOYEES AND THEIR MOVEMENT.
