I'M CHERYL SMITH, CHAIR OF THE PLANNING AND ZONING COMMISSION.

THIS MEETING OF THE PLANNING AND ZONING COMMISSION MEETING IS HERE BY CALL BACK TO ORDER AT 6:37 PM THE PLANNING AND ZONING COMMISSION MEETS THE SECOND AND FOURTH TUESDAY OF EACH MONTH.

ALL MEETINGS ARE VIDEO RECORDED.

NO OFFICIAL ACTION CAN TAKE, CAN BE TAKEN UNLESS PROPER APPLICATION HAS BEEN SUBMITTED THROUGH THE PLANNING DEPARTMENT.

THE PLANNING AND ZONING COMMISSION FOLLOWS A PRINTED AGENDA THAT IS AVAILABLE ONLINE PUBLIC HEARING CONSENT AGENDA ITEMS ARE ROUTINE ITEMS, WHICH CAN ALL BE APPROVED IN ONE MOTION.

AGAIN, YOU CAN KIND OF SEE THE NEW DEVELOPMENT HERE TO THE SOUTH, INCLUDING KOHL'S AND THE HIGH SCHOOL.

HERE'S THE SITE PLAN FOR THE SIT DOWN RESTAURANT, UM, CALLED BABAS.

THEY WILL BE SELLING, YOU KNOW, BURGERS, UM, YOU KNOW, UH, STEAKS AND PIZZA AND SO ON AND SO FORTH.

IT'S A SCRATCH KITCHEN.

UM, THEY ARE COMPLYING WITH THE DENSITY AND DIMENSIONAL REQUIREMENT.

THEY ARE EXCEEDING THE PARKING MINIMUM.

UH, AGAIN, IN THIS CORRIDOR OVERLAY THIS STREET, WE TRY TO DISCOURAGE, UM, LARGE FIELD OF PARKING AREAS.

SO YOU'VE SEEN THESE VARIANCES COME UP WITH OTHER RESTAURANTS SUCH AS BLACK D, BLACK BEAR DINERS, AND, UH, SHAKE SHACK AND SO ON AND SO FORTH.

SO THEY ARE REQUESTING A VARIANCE TO PROVIDE 160 PARKING.

HOWEVER, THEY'RE MEETING THE, UH, COMPENSATORY OR REQUIREMENT BY PROVIDING PERMEABLE PARKING SPACES.

THEY'RE COMPLYING WITH THE LANDSCAPING REQUIREMENT.

AND HERE ARE THE PROPOSED BUILDING ELEVATIONS.

THIS WILL BE THE ELEVATIONS FACING 1 61.

THEY DO HAVE, UH, OUTDOOR PATIO AREA.

SO WHAT YOU'RE SEEING IS JUST A COVERED AREA FOR THAT.

THEY ARE COMPLYING WITH APPENDIX F REQUIREMENTS.

UM, THEY, AND THEY ARE REQUESTING TWO VARIANCES.

ONE, AS I MENTIONED, THE NUMBER OF PARKING SPACES.

TYPICALLY, RESTAURANTS NEED MORE THAN THE PARKING MAXIMUM THAT WE TYPICALLY PUT ON A, UH, OVERLAY PROJECTS.

AND THEY ARE REQUESTING THE OVERALL WINDOW PERCENTAGES.

THEY ARE ACTUALLY PROVIDING SUBSTANTIAL AMOUNT OF, UH, MASONRIES AND CANOPIES AND WINDOWS.

HOWEVER, THEY WERE NOT ABLE TO COMPLY WITH THE 50 EITHER LENGTH OR AREA REQUIREMENTS.

SO THEY ARE REQUESTING THAT VARIANCE.

AGAIN, WE HAVE GRANTED SIMILAR VARIANCES FOR PAT'S RESTAURANTS AND, UM, OTHER, UH, RESTAURANTS THAT ARE IN THE EPICENTER, INCLUDING, UM, RAISING CANES AND, UH, SHAKE SHACK AND SO ON AND SO FORTH.

UH, SO D RC RECOMMENDS APPROVAL.

THIS CONCLUDES THAT PRESENTATION.

IS THERE ANY QUESTION FOR STAFF AT THIS TIME? COMMISSION DON'T HAVE ANY QUESTIONS.

UH, COMMISSIONER FEDCO, JUNE? YES.

AND MAYBE IT'S THE APPLICANT TO, TO ANSWER, BUT THEY'RE ASKING FOR THREE TIMES THE AMOUNT OF PARKING SPACES THAT WOULD OTHERWISE BE, RIGHT.

IS THERE A REASON FOR THAT? UM, TYPICALLY THAT WOULD TRULY BE THE BEST ANSWER BY THE, UH, APPLICANT.

HOWEVER, OUR PARKING MAXIMUM IS CALCULATED ONLY ON THE DINING AREA AND THE, UH, LOBBY AREA.

IF THEY HAVE LIKE A HO HOSTESS TRYING TO, PEOPLE, LIKE A LOBBY AREA FOR PEOPLE TO WAIT FOR TO BE SEATED.

SO TYPICALLY RESTAURANTS REQUEST THESE VARIANCES BASED ON WHAT THEY KNOW THAT THEIR DEMAND WOULD BE.

BUT THE ONLY, THE ONLY CONCERN I HAD, YES.

A GOOD QUESTION, COMMISSIONER, IS THAT HAVE THEY HAD THEY HAD A CONVERSATION WITH THE NEIGHBORING BUSINESSES BECAUSE THAT WOULD BE, YOU KNOW, IMPLEMENT, I MEAN, THEIR SPACE WOULD BE, IT WOULD NOT HAVE ENOUGH FOR THEIR CUSTOMERS AS WELL.

RIGHT.

SO RIGHT NOW, IF YOU, AS YOU CAN SEE, UM, THIS IS THE SALAD AND GO IN DUBISKI HIGH SCHOOL.

THEY'RE ONLY DEVELOPING THE SOUTHERN PORTION.

AND THE KOHLS AND OTHER RETAIL CENTERS ARE ACTUALLY ACROSS THE CREEK.

AND JUST AS PART OF THE ANALYSIS AND WHAT WE'RE BASING THIS OFF OF, WHAT I HAVE ON THE SCREEN IS, UH, NORTH CENTRAL TEXAS COUNCIL OF GOVERNMENT, UH, THE MODELING EFFORTS.
