THE STAFF BRIEFING ON THE PLANNING AND ZONING COMMISSION MEETING IS HERE BY CALL LAURA, 5:33 PM THIS PORTION OF THE MEETING IS WHERE THE STAFF BRIEFS THE COMMISSION AND PREVIEWS THE CASES.

THE PROPERTY IS ZONED LIGHT INDUSTRIAL AND IS WITHIN THE 1 61 CORRIDOR OVERLAY AND CONSISTS OF JUST A LITTLE BIT OVER TWO ACRES.

UM, HERE IS AN AERIAL WITH THE SUBJECT PROPERTY OUTLINED IN ORANGE.

YOU CAN SEE THE SURROUNDING ZONING AS WELL AS, AS WELL AS THE LAND USES TO THE NORTH.

WE HAVE SINGLE FAMILY, ONE DISTRICT, THERE ARE HOMES AND UNDERDEVELOPED PROPERTY.

TO THE SOUTH IS LIGHT INDUSTRIAL.

IT'S DEVELOPED WITH CONTRACTOR SHOP ALSO TO THE WEST AND SOUTH.

WE HAVE LIGHT INDUSTRIAL AGAIN WITH A CONTRACTOR SHOP.

AND THEN TO THE EAST WE HAVE 1 61.

ON THE OTHER SIDE OF THE HIGHWAY IS, UM, PD 4 44, AND WE ARE UNDER CONSTRUCTION FOR AN INDUSTRIAL WAREHOUSE.

JUST A LITTLE HISTORICAL CONTEXT.

ON SEPTEMBER 16TH, 2025, THE CITY COUNCIL APPROVED, APPROVED AN ORDINANCE TO AMEND THE FUTURE LAND USE CLASSIFICATION TO LIGHT INDUSTRIAL AND ALSO APPROVED AN ORDINANCE CHANGING THE ZONING CLASSIFICATION FROM SINGLE FAMILY ONE TO LIGHT INDUSTRIAL DISTRICT.

REGARDING THE OPERATIONAL PLAN, THE APPLICANT IS PROPOSING TO OPERATE A MECHANICAL CONTRACTOR SHOP WITH OUTSIDE STORAGE.

MOST OF THE SUPPLIES THAT ARE USED FOR THE BUSINESS WILL BE STORED INSIDE THE SHOP AND WAREHOUSE WITH THE EXCEPTION OF VEHICLES SUCH AS BOX AND BUCKET TRUCKS, TRAILERS, TRAILER MOUNTED EQUIPMENT, AND OTHER LIGHT EQUIPMENT, UM, NEEDED FOR THE BUSINESS.

THE SITE PLAN MEETS OUR DENSITY AND DIMENSIONAL REQUIREMENTS AS WELL AS THE PARKING REQUIREMENTS.

THE SITE BOUNDARIES ARE OUTLINED IN RED.

YOU CAN SEE THE TWO PROPOSED STRUCTURES THERE IN ORANGE.

THE SHOP AND WAREHOUSE IS 9,892 SQUARE FEET AND THE PROPOSED OFFICE IS 3,834 SQUARE FEET.

THE LANDSCAPE PLAN ALSO MEETS OR EXCEEDS THE LANDSCAPING REQUIREMENTS.

THE APPLICANT IS PROPOSING TO PROVIDE A SIX FOOT MASONRY WALL SHOWN IN RED, AS WELL AS A SIX FOOT WROUGHT IRON FENCE CONNECTING THE BUILDINGS ON THE HIGHWAY 1 61 FRONTAGE.

THESE ARE THE BUILDING ELEVATIONS FOR THE OFFICE.

THE ELEVATIONS DO MEET OUR APPENDIX X REQUIREMENTS.

THE EX EXTERIOR MATERIALS ARE BRICK AND STONE WITH PAINTED METAL ACCENT.

THE GLAZING AND ARTICULATION MEETS OR EXCEEDS THE APPENDIX X AND THE APPLICANT IS PROPOSING METAL CANOPIES IN ACCENT LIGHTING.

THESE ARE THE ELEVATIONS FOR THE SHOP AND WAREHOUSE.

AGAIN, THE ELEVATIONS MEET OR EXCEED THE APPENDIX X REQUIREMENTS.

IT DIDN'T MEET OUR INDUSTRIAL STANDARDS, SO WE WANTED TO REDUCE IT TO COMMERCIAL STANDARDS.

AND IN THAT WE WANTED TO LIMIT 18 WHEELERS.

SO 40 FOOT IS TYPICAL.

THE TYPICALLY SMALLEST 18 WHEELER VARI.

SO THAT'S THE SMALLEST ONE.

YEAH.

SO THAT'S WHY WE, WE WANNA MAKE SURE THAT THAT WAS THE CUTOFF.

AND SO UNDER THAT WOULD BE BOX TRUCKS, WORK TRUCKS, THINGS LIKE THAT.

UM, ANY BIGGER THAN THAT, THE DRIVEWAYS REALLY DON'T SUPPORT THOSE TYPES OF VEHICLES.

SO WE WANTED TO MAKE SURE WE HAD THAT IN THE SUP.

IT SOUNDS LIKE A LOT OF HEAVY DUTY TRUCKS GONNA BE THERE AND THE ROADS ITSELF AND THE, SO THEY, THEY NEED TO BE IMPROVED TO BEAT THOSE THINGS.

THIS SIDE, NOT NECESSARILY THE HEAVY DUTY TRUCKS.

IT'LL BE THE LIGHT COMMERCIAL VEHICLES AND POTENTIALLY BOX TRUCKS.

UM, SO IT WOULDN'T BE LIKE YOUR TYPICAL WAREHOUSING FACILITY THAT HAS A LOT OF 18 WHEELER MM-HMM .

TRAFFIC.

UM, SO WE DON'T ANTICIPATE A LOT OF, UH, ROAD MAINTENANCE BEING ACQUIRED AS PART OF THIS SITE, BUT I DO WANNA INDICATE THAT THE AREA AROUND IT IS ALREADY PRETTY INDUSTRIAL.

SO WE DO SEE SOME DRUNK TRAFFIC IN THE AREA ALREADY.

ON MAY 7TH, 2024, CITY COUNCIL APPROVED A PD AMENDMENT TO CREATE A DEFINITION FOR PRIVATE CARD ROOM, UM, AND AMEND THE USES PERMITTED WITHIN PD TWO 17 TO ALLOW A PRIVATE CARD ROOM WITH CITY COUNCIL APPROVAL OF A SUP.

AND THEN ON MAY 21ST, 2024 CITY COUNCIL APPROVED A SUP FOR A PRIVATE CARD ROOM REQUIRING A ONE YEAR REVIEW.

UM, AND THEN JULY 18TH, 2025.

SO JULY 18TH OF THIS YEAR, A CERTIFICATE OF OCCUPANCY WAS ISSUED FOR A PRIVATE CARD ROOM AT 4 0 1 EAST PALACE PARKWAY.

UM, THESE ARE THE FLOOR PLANS THAT WERE INCLUDED IN THE ORIGINAL SUP ORDINANCE.

SO THE OPERATIONS AND COMPLIANCE REVIEW, PALACE POKER OPERATES AT 4 0 1 EAST PALACE PARKWAY AND THEN THE PRIVATE CARD ROOM IS DEFINED AS A PRIVATE PLACE WHERE MEMBERS GATHER TO PLAY CARD GAMES INCLUDING POKER, BILLIARDS, CHESS, OR OTHER SIMILAR GAMES.

THE CURRENT OPERATIONAL HOURS ARE MONDAY THROUGH SUN, MONDAY THROUGH SUNDAY, 10:00 AM TO 2:00 AM UM, AND THE CURRENT MEMBERSHIP MINIMUM LENGTH IS THREE MONTHS.

THE OWNER DID CONFIRM THAT IDS ARE CHECKED FOR 21 AND OVER BEFORE ENTERING AND MEMBERSHIP CARDS ARE ISSUED AT THAT TIME AS WELL.

UM, THEY DO HAVE A-T-A-V-C LICENSE FOR ALCOHOL AND THEY SERVE AN ALL DAY MENU, UM, FOR FOOD AND ALCOHOLIC BEVERAGES.

PUBLIC HEALTH AND ENVIRONMENTAL QUALITY WAS ALSO, UM, PART OF THIS REVIEW.

THEY DID NOT FIND ANY VIOLATIONS TO REPORT.

UH, TO THIS NOTE, THE APPLICANT DID CONFIRM THAT IF THEY ARE APPROVED FOR 24 HOURS, THAT THEY WILL NOT SERVE ALCOHOL BEYOND THE 2:00 AM TABC LIMIT.

UH, THE POLICE DEPARTMENT ALSO WAS PART OF THIS REVIEW.

THEY ALSO REPORTED NO INCIDENTS OR ISSUES OF SIGNIFICANCE.

HOWEVER, THEY DID NOTE THAT IF THE HOURS ARE EXTENDED, THE APPLICANT SHOULD MAINTAIN ONSITE SECURITY AND ENFORCE MINIMUM AGE OF 21 FOR BOTH EMPLOYEES AND MEMBERS AND A SUBSEQUENT ONE YEAR REVIEW BE REQUIRED.

UM, SO THE STAFF DID CONFIRM WITH THE APPLICANT THAT THEY ADHERE TO KEY SECURITY AND SAFETY ME MEASURES.

UM, THERE ARE SIGNS POSTED AT ALL PUBLIC ENTRANCES AND EXITS, AND ALSO NEAR THE C CAGE INDICATING SECURITY ALARMS ARE IN USE.

THEY HAVE HIGH RESOLUTION SURVEILLANCE CAMERAS, UM, IN THE PARKING AREA AND ON THE INTERIOR AS WELL.

AND THEY ALSO DO NOT HAVE ANY SMOKING INSIDE OF THE, UH, POKER ROOM.

STAFF FINDS THAT THE OPERATIONS ARE IN COMPLIANCE WITH ALL EXISTING SUP CONDITIONS, UM, AND THE DEVELOPMENT REVIEW COMMITTEE RECOMMENDS APPROVAL WITH THE FOLLOWING CONDITIONS, UM, AMEND THE OPERATIONAL HOURS TO 24 HOURS AND THE MINIMUM MEMBERSHIP DURATION TO ONE WEEK.

ALL OTHER EXISTING CONDITIONS FROM THE SUP WHICH WAS APPROVED MAY 21ST, 2024 SHALL REMAIN IN EFFECT.

UM, AND LASTLY, THAT CITY COUNCIL SHALL CONDUCT A, A, A PUBLIC HEARING IN ONE YEAR AFTER CITY COUNCIL APPROVAL OF THIS SUP AMENDMENT TO CONFIRM COMPLIANCE WITH ALL APPLICABLE CODES AND REGULATORY REQUIREMENTS.
