BRIEFING OF THE ZONING COMMISSION MEETING IS HEREBY CALL TO ORDER AT 5:32 PM THIS PORTION OF THE MEETING IS WHERE THE STAFF BRIEFS THE COMMISSION AND PREVIEWS THE CASES ON TONIGHT'S D AGENDA.

COMMISSION MEMBERS WILL HAVE THE OPPORTUNITY TO ASK QUESTIONS THAT MAY FACILITATE THE MEETING AND THE PRESENTATION OF THE CASES.

THE FES ITEM ON THE AGENDA IS A TEXT AMENDMENT T 25 0 9 0 0 3 4 FOR APPENDIX S DEVELOPMENT STANDARDS FOR MULTIFAMILY AND MIXED USE RESIDENTIAL DEVELOPMENTS.

UH, WHAT THIS REQUEST DOES, IT CREATES APPENDIX S UM, DEVELOPMENT STANDARDS FOR MULTIFAMILY AND MIXED USE RESIDENTIAL DEVELOPMENTS FOR MULTIFAMILY AND MIXED USE RESIDENTIAL DEVELOPMENT SUBJECT TO SB EIGHT 40.

AND THE PURPOSE OF THESE CHANGES AND WHAT, WHAT THEY INTEND TO ACCOMPLISH, UM, IS TO ENCOURAGE THE CONTINUATION OF HIGH QUALITY GROWTH WITH DESIGN STANDARDS THAT WILL HELP PRESERVE OR IMPROVE THE CHARACTERISTICS OF SURROUNDING DEVELOPMENTS AND ENSURE THE CONTINUED HEALTH, SAFETY, COMFORT AND MOBILITY OF THE CITY.

UM, SO THE COMPLETE CHANGES WERE IN YOUR PACKET.

UH, I'LL, I'LL SUMMARIZE THEM.

UM, THE FIRST, UH, THE DENSITY REQUIREMENTS AND SETBACKS AND THE HEIGHT ARE STIPULATED BY SB EIGHT 40.

AND THIS JUST ARTICULATES THIS IN APPENDIX S UH, WE ARE SETTING A MAXIMUM NUMBER OF FIVE BUILDINGS THAT INCLUDE THE LEASE BUILDING OR CLUBHOUSE.

UH, WE ARE ALSO SETTING THE MINIMUM SQUARE FOOTAGE FOR ONE BEDROOM UNITS AT 1000 SQUARE FEET.

UH, WE'RE ALSO STIPULATING THE BREAKDOWN OF DIFFERENT UNIT MIX.

SO WE ARE REQUIRING ONE BEDROOM UNITS ACCOUNT FOR 10% OF THE TOTAL UNITS.

UH, TWO BEDROOM UNITS ACCOUNT FOR 30% OF, UH, TOTAL UNITS, AND THEN THREE BEDROOM UNITS COUNT FOR 60% OF THE TOTAL UNITS.

UM, WE'VE, UH, ADDED SOME SCREENING REQUIREMENTS SO THAT WALLS ADJACENT TO RESIDENTIAL SLASH COMMERCIAL ZONE RESIDENTIAL OR COMMERCIAL ZONE PROPERTIES, UH, REQUIRES A 10 FOOT MASONRY.

WALL WALLS ADJACENT TO THE RIGHTS OF WAY, UH, REQUIRE AN EIGHT FOOT MASONRY WALL.

UH, AN EXCEPTION MAY BE REQUESTED FOR WR IRON FENCING WITH COLUMNS, AND THAT CAN BE GRANTED AT THE DISCRETION OF THE PLANNING AND DEVELOPMENT DIRECTOR OR DESIGNEE.

UH, FOR THE LANDSCAPING REQUIREMENTS, WE ARE REQUIRING 30% OF THE TOTAL SQUARE FOOTAGE OF THE SITE BE LANDSCAPING LANDSCAPED, AND THEN REQUIRING A MINIMUM OF FOUR INCH CALIPER TREES AT A MINIMUM OF EIGHT FEET.

AT THE TIME OF PLANTING, UH, ONE TREE FOR EVERY 500 SQUARE FEET OF REQUIRED LANDSCAPING AREA, UM, FOR THE POOL, WE ARE REQUIRING AN OUTDOOR SWIMMING POOL AT A MINIMUM SIZE OF 13,000 448 48 SQUARE FEET OF SURFACE AREA.

WE'RE REQUIRING A TRAIL THAT GOES THROUGH THE PROPERTY.

IT MUST BE A MINIMUM OF SIX FOOT WIDE TRAIL, AND THE LENGTH OF THAT TRAIL HAS TO EQUAL OR EXCEED 25% OF THE PERIMETER OF THE PROPERTY.

UH, TRAIL MUST THEN CONNECT TO ABUDDING SIDEWALKS OR TRAILS WITHIN THE GRAND PRAIRIE PARK'S MASTER PLAN.

AND SO FOR THE PORTIONS OF THE TRAIL OUTSIDE OF THE DEVELOPMENT, UH, THE WIDTH OF THOSE CONNECTIONS SHALL BE, UH, THE LARGER WIDTH NOTED IN ARTICLE 12 OF THE UDC, THE PARKS MASTER PLAN OR THE BIKE MASTER PLAN.

AND FOR THE OFF STREET PARKING STANDARDS, WE'RE REQUIRING A PARKING DIMENSION OF 10 FEET BY 20 FEET.

AND THEN WE'RE NOT ALLOWING COMPACT PARKING, UH, STORMWATER IF STORMWATER MANAGEMENT'S REQUIRED FOR THE DEVELOPMENT, IT SHALL BE PROVIDED AS A RETENTION BASIN.

UH, THE UTILITIES MUST A, UH, BE ADEQUATELY SERVED PER CITY REQUIREMENTS.

AND THEN WE'VE ADDED A PUBLIC ART COMPONENT REQUIREMENT.

UH, SO ONE ART PIECE REQUIRED IN THE LANDSCAPE PLAN, UH, IN THE CLUBHOUSE AREA OR SOMETHING THAT'S VISIBLE FROM THE RIGHT OF WAY.

UH, THE VALUE OF THAT HAS TO EQUAL OR BE GREATER TO $4 PER SQUARE FEET OF THE BUILDING STRUCTURES, UH, THAT INCLUDE DWELLING UNITS.

AND THEN IN LIEU OF ARTWORK ON SITE, UH, THE DEVELOPERS HAVE AN ABILITY TO CONTRIBUTE TO THE CITY'S PUBLIC ART FUND AND AN AMOUNT EQUAL TO 12 OR $2 PER SQUARE FEET OF THE PUBLIC, UM, STRUCTURES CONTAINING DWELLING UNITS.

AND WE HAVE ADDITIONAL ART STANDARDS IN THERE THAT MUST BE PERMANENTLY AFFIXED AND WEATHER RESISTANT.

AND THEN THE OWNER OF THE DEVELOPMENT IS RESPONSIBLE FOR MAINTAINING THAT ARTWORK.

UM, SO WE ARE PRESENTING THIS ITEM, UH, BEFORE YOU ON THIS AGENDA.

IT IS ALSO ON CITY COUNCIL'S AGENDA FOR CONSIDERATION.

SO THE DEVELOPMENT REVIEW RECOMMENDS APPROVAL AND I'M AVAILABLE FOR ANY QUESTIONS.

THE MR. SAY ANY QUESTIONS ON THIS? THIS WAS A HUGE FACTOR IN INFORMATION A LOT, YOU KNOW, UM, AND MY UNDERSTANDING IS THAT WE DON'T HAVE ANY CONTROL OVER WHAT THE, UH, LEGISLATURE DOES AND THEY'VE DONE WHAT THEY'VE DONE.

BUT MY CONCERN, THIS, WHAT WE'RE DOING TONIGHT IS JUST TO, TO CLARIFY AND TO MAKE, UM, UM, TRY TO STILL WATCH OVER OUR CITY IN A MATTER THAT THE, UH, ANYTHING BEING DONE IS STILL FITS OUR VEIL, SO TO SPEAK.

YES, IT'S INTENDED TO, IF I'M NOT SAYING THAT CORRECTLY, BUT YES, IT'S INTENDED TO CONTINUE HIGH QUALITY GROWTH WITH DESIGN STANDARDS THAT HELP PRESERVE OR IMPROVE THE CHARACTERISTICS OF SURROUNDING DEVELOPMENTS AND ENSURE THE CONTINUED HEALTH, SAFETY, COMFORT AND MOBILITY OF THE CITY.

YEAH, I GUESS THE ONLY BIG CONCERN I HAD WAS WHEN IT, WHEN THE, THE LEGISLATURE SAID THAT ANYTHING THAT'S GENERAL IN THE RETAIL, I MEAN THAT MEANS THAT THEY COULD JUST PUT APARTMENTS ANYWHERE THEY CHOOSE, BUT, BUT THEY CAN ONLY DRAW THE LINE.

IT IS CLOSE TO AN INDUSTRIAL AREA.

IS THAT HOW THAT READ? SO IT, IT IS AVAILABLE, THE SB EIGHT 40, UH, ALLOWS MULTIFAMILY AND MIXED USE, UH, RESIDENTIAL PROJECTS WITHIN AREAS THAT ARE ZONED FOR COMMERCIAL RETAIL AND OFFICE.

UH, THERE ARE SOME EXCEPTIONS TO THAT RULE, UM, FOR ZONING DISTRICTS THAT ALLOW HEAVY INDUSTRIAL USES OR WITHIN 1000 FEET OF AN AN EXISTING HEAVY INDUSTRIAL USE.

AND THEN THE LAST THING, AND THEN I THINK THAT, UH, COMMISSIONER ERY HAD A QUESTION IS THAT IN SOME INSTANCES WE YOU HAVE NO INPUT AT ALL THAT THEY'LL BE ABLE TO DO WHAT THEY WANT TO DO.

THEY WILL HAVE TO FOLLOW THE RULES STIPULATED IN SB EIGHT 40, UH, THOSE THAT ARE NOT SPECIFIED IN THAT DEFAULT TO OUR UDC.

SO THEY WILL HAVE TO MEET THOSE REQUIREMENTS.

UM, BUT HOW DOES THIS STACK UP AGAINST THE STATE? LIKE ARE WE LOOKING AT ANY SORT OF LEGAL RAMIFICATIONS BY DOING THIS OR IS THIS ALLOWED? HAVE ANY OTHER CITIES DONE ANYTHING LIKE THIS YET? SO I WILL NOT SPEAK ON THE LEGAL RAMIFICATIONS.

I WILL JUST NOTE THAT SB EIGHT 40 INCLUDES THINGS THAT THE CITY CANNOT CONTROL.

SO FOR EXAMPLE, UM, THE HEIGHT AND THE DENSITY, IT DOES NOT SAY THAT WE CANNOT REQUIRE CERTAIN OTHER ELEMENTS.

SO THE ELEMENTS THAT WE ARE STILL ABLE TO CONTROL, WE HAVE REQUIREMENTS FOR IN OUR UDC.

AND SO TO, UH, CHANGE THAT, WE WOULD REQUEST IT

THE SUBJECT PROPERTY IS LOCATED ON A BLOCK THAT IS PREDOMINANTLY SINGLE FAMILY RESIDENTIAL USE, AND THE PROPOSED USE IS CONSISTENT WITH THE EXISTING DEVELOPMENTS TO THE NORTH, SOUTH, AND WEST.

AND AGAIN, THIS IS A ACCOMPANYING ZONING CHANGE, ZERO N TWO FIVE DASH OH EIGHT DASH 0 0 3 1, WHICH IS A ZONING CHANGE REQUEST FOR 4 0 2 AND 4 0 6 NORTHWEST 20TH STREET.

AND 50 NOTICE, 51 NOTICES WERE SENT OUT TO THE SURROUNDING PROPERTY OWNERS, ZERO RETURN IN FAVOR OR OPPOSED.

AND AGAIN, THE RECOMMENDATION IS GONNA BE THE SAME.

UH, WE WANT TO NOTE THAT UH, THERE IS, UH, PROPERTIES LOCATED ON THE SAME BLOCK THAT DO ALLOW FOR THAT, DO HAVE RESIDENTIAL HOMES ON IT CURRENTLY.
