NEXT ITEM ON THE AGENDA IS A HEARING CONCERNING DANGEROUS STRUCTURE LOCATED AT 1605 ACOSTA STAFF.OH, THIS IS GOING TO BE A, A ONE ONE TRIP PONY TONIGHT.
I'M GLAD MOST OF Y'ALL SHOWED UP.
UH, THE 1605 ACOSTA, IT'S THERE NORTH OF MARSHALL KINGSTON.
THAT'S WHAT EAST OF, UH, OF THIRD STREET, WEST OF, UH, INE.
UH, THIS STARTED, UH, BACK IN THIS TO, TO BRING Y'ALL UP TO SPEED.
IF Y'ALL DON'T REMEMBER THIS STARTED BACK IN JULY OF 2023.
UH, THE ORIGINAL COMPLAINT WAS OVERHANGING TREE LIMBS OVER A SIDEWALK.
AND THE CODE OFFICER DID HER INITIAL INSPECTION AND SAID, OH, THERE'S A HOLE IN THE ROOF.
AND SO IT STARTED THEN AND, UH, THERE WAS NOTIFICATION AND POLICE FIX THE ROOF, FIX THE HOLE IN THE ROOF, AND OVER TIME, WITH A HOLE IN THE ROOF SINCE 2023, THE WATER GETS IN AND IT STARTS, UH, IT'S CAUSING DETERIORATION.
SO WE'VE BEEN HERE BEFORE AND, UH, THIS, UH, THIS HOMEOWNER, AND YOU KNOW HER NOW
UH, WE, UH, BEEN WORKING WITH HER, UH, TRYING TO GET HER TO WHERE SHE CAN GET IT FIXED.
AND I THINK, AND SHE EVEN SAYS, I DON'T THINK SHE WOULD BE EMBARRASSED FOR ME TO, TO SAY THAT.
IT'S, IT'S ABOUT MONEY A LOT OF TIMES.
UH, SO THIS IS THAT PICTURE IN, IN, BACK IN MAY OF 2023.
AND, UH, AND, AND I, I DON'T THINK IT WAS, MAYBE THIS WAS LATER THAN 2023, BECAUSE I THINK THAT INITIAL HOLE WASN'T THAT BAD.

AND THESE ARE YOUR FINDINGS AND ACCORDANCE WITH APPLICABLE LAW.
NOTICE OF THIS HEARING WAS GIVEN TO THE OWNER LIEN HOLDER AND OTHER PARTIES WITH AN INTEREST IN THE PROPERTY.
IT'S LOCATED AT 1605 ACOSTA GRAND PRAIRIE, TEXAS.
THE RESIDENCE LOCATED AT THE, ON THE PROPERTY.
THE STRUCTURE CONTAINS HOLES IN THE ROOF THAT HAVE LED TO DAMAGE TO THE INTERIOR OF THE HOUSE, INCLUDING A COLLAPSED CEILING AND WARPING OF THE ROOF DECK.
THE STRUCTURE IS VACANT, IT SHOWS SIGN OF VANDALISM AND UNAUTHORIZED ACCESS.
THE STRUCTURE CONTAINS A MOLD LIKE SUBSTANCE.
THE STRUCTURE IS A SUBSTANDARD STRUCTURE AS THAT TERM IS DEFINED IN GRAND PRIX CODE OF ORDINANCES 29 THROUGH 18, 12, 7, 9, AND 11.
THE STRUCTURE'S DANGEROUS STRUCTURE AS THAT TERM IS DEFINED IN GRAND GRAND PRIX, CODE OF ORDINANCES, SECTION 29 28, 4 5 7 8, 12, 13, 15, AND 17, AND IN APRIL.
THESE WERE Y'ALL'S ORDERS ENSURE THE STRUCTURE IS REPAIRED, REMOVED, OR DEMOLISHED IN ACCORDANCE TO APPLICABLE LAW WITHIN 30 DAYS OF THE DATE OF THE ORDER.
SECURE THE PROPERTY AND RE REMOVE ALL THOSES FROM THE EXTERIOR YARD AND KEEP THE STRUCTURE SECURED FROM ENTRY UNTIL THE STRUCTURE IS IN COMPLIANCE WITH APPLICABLE LAW.
THE OWNER SHALL APPEAR AT THE NEXT BUILDING AND ADVISORY APPEAL BOARD ON MAY 5TH AT 6:00 PM AT AT CITY OF GRAND PRAIRIE CITY COUNCIL CHAMBERS, 300 WEST MAIN STREET, GRAND PRAIRIE, TEXAS, WITH

A DETAILED PLAN FROM A CONTRACTOR, WHICH CONCLUDES A PLAN OF ACTION FOR THE NEXT 30, 60, 90, AND 120 DAYS.THE BOARD MAY CONSIDER EXTENDING THE TIME FOR COMPLIANCE AT THAT TIME.
IF THE OWNER FAILS TO KEEP THE STRUCTURE SECURE FROM ENTRY, THE CITY IS AUTHORIZED TO SECURE OR RE RESECURE THE STRUCTURE AT THE PROPERTY OWNER'S EXPENSE.
SHOULD THE OWNER FAIL TO COMPLY WITH THE ORDER, THE CITY IS AUTHORIZED AT ITS DISCRETION TO REPAIR, REMOVE OR DEMOLISH THE STRUCTURE AND ANY ACCESSORY REQUIRED TO BE DEMOLISHED AT THE OWNER'S EXPENSE, OR IN THE ALTERNATIVE, ASSESS A CIVIL PENALTY IN THE AMOUNT OF $1,000 PER DAY FOR EACH DAY THAT THE STRUCTURE CONTINUES TO BE IN VIOLATION.
UNLESS THAT STRUCTURE IS A HOMESTEAD, IN WHICH CASE THE AMOUNT OF THE CIVIL PENALTY SHALL BE REDUCED AS REQUIRED BY TEXAS LAW, ANY EXPENSE OWED TO THE CITY BY THE OWNER WILL BE BILLED TO THE OWNER.
FAILURE TO PAY THE CHARGES WILL RESULT IN A LIEN PLACED ON THE PROPERTY.
SUCH COSTS, PENALTIES, OR EXPENSES SHALL ACCRUE AT AN INTEREST RATE OF 10% PER ANNUM.
THE CITY SHALL HAVE ALL REMEDIES PROVIDED BY LAW TO RECOVER MONEY OWED THE CITY, INCLUDING THE RIGHT TO PLACE THE LIEN ON THE PROPERTY.

SO WE'RE, WE'RE WORKING THROUGH THAT.
SO THIS WAS A, YOU KNOW, MAY, JUNE.
SO YOU, YOU CAN SEE THE YARD STAYS MAINTAINED.
IT'S ALWAYS CLEAN AROUND THERE.
I DRIVE BY IT AT LEAST ONCE A WEEK, USUALLY TWICE.
UH, THIS IS A LATER PICTURE FROM, AND THIS MAY HAVE BEEN LAST, LAST MONTH, AND THE PROGRESS WE WERE MAKING WAS THERE WAS A, A ROOFING SIGN PUT IN THE FRONT YARD, BUT WE HAVEN'T DONE MADE IT ANY FURTHER.
UH, MS. MALONE HAS, HAS TRIED AND, AND COUNSEL WILL PEOPLE, AND, AND Y'ALL HAVE ORDERED HER TO COME BACK WITH A DETAILED PLAN AND TIMELINE AND SHE HASN'T REALLY BEEN ABLE TO PROVIDE THAT AS OF YET.
I'M THINKING MAYBE THAT MIGHT CHANGE TONIGHT, I HOPE.
'CAUSE I THINK SHE HAS GOOD NEWS FOR YOU GUYS.
SO, AS A RECAP ON IN MAY, Y'ALL HELD THE HEARING AND THE HEARING WITH OWNER OF THE PROPERTY DID NOT PRESENT A DETAILED PLAN THAT'S SCHEDULED FOR THE WORK.
UH, THE BOARD FOUND THE OWNER DID NOT HAVE ADEQUATE TIME TO, AND THIS IS THE, A COMMON THEME TO BRING THE PROPERTY INTO COMPLIANCE WITH THE DATE.
CURRENTLY ESTABLISHED AN ORDER, THEY'LL EXTENDED THE, UH, DEADLINE BY 60 DAYS.
UH, AT SIX TWO OF 25, WE HELD ANOTHER HEARING IN THE PROPERTY.
UH, WELL ACTUALLY, WELL THE ORDER TO COME BACK ON JUNE 2ND, SO THEY'RE BACK ON JUNE 2ND.
AT THE HEARING, THE OWNER DID NOT PRESENT A DETAILED PLAN AND TIME SCHEDULED FOR WORK.
THE BOARD EXTENDED TIME ONCE AGAIN TO JULY 7TH IN ORDER THE OWNER TO APPEAR AT THE BOARD MEETING ON THAT DATE.
AND ON JULY 7TH, THE PROPERTY OWNER STATED SHE HAD SUBMITTED INSURANCE COMPLAINT, SO, UH, CLAIM AND THE ADJUSTER HAD BEEN AT THE PROPERTY EARLIER THAT DAY, SO SHE WAS MAKING A LITTLE PROGRESS THERE.
SHE ALSO INDICATED SHE FOUND A ROOFING CONTRACTOR WHO OFFERED FINANCING.
AFTER THE HEARING, Y'ALL EX AGAIN EXTENDED THE TIME TO COMPLY.
AND THEN WE WERE BACK HERE IN AUGUST.
AND WITH, AT THE HEARING, STILL WASN'T A DETAILED PLANNER TIME SCHEDULE, BUT AN UPDATE ON THE COMMUNICATION SHE HAD HAD WITH, WITH HER CONTRACTORS AND AND FINANCES.
UH, SHE REPORTED THAT FURTHER DISCUSSIONS THAT WAS NOT FEASIBLE.
SHE FURTHER REPORTED THAT CONTRACTOR ADVISED HER REMEDIATE THE MOLD LIKE SUBSTANCE IN THE HOUSE BEFORE BEGINNING THE REPAIR OF THE ROOF, AND THAT SHE HAD SCHEDULED WITH HER CONTRACTOR TO FIND THE BEST CASE SOLUTION.
AFTER THE HEARING, THE BOARD EXTENDED THE TIME TO COMPLY TO SEPTEMBER 10TH TODAY AND ORDERED THE OWNER TO APPEAR SEPTEMBER 10TH WITH HER CONTRACTOR WITH A PLAN OF ACTION AND TIMELINE TO COMPLETE THE REPAIRS.
UH, NO THINK FOR SURE SHE HAS A CONTRACT.
SO THERE'S SOME PROGRESS THAT'S MORE THAN JUST A SIGN.
THAT'S A, A ROLL OFF DUMPSTER OUT THERE.
SO THE CONTRACTOR ACTUALLY CONTACTED, UH, CHAD OVER THE WEEKEND.
I DON'T KNOW WHAT THE CONVERSATION, BUT HE SAID CHAD ADVISED HIM THAT HE NEEDED TO GET PERMITS.
I CHECKED, THEY HAVEN'T GOT THOSE YET, BUT HE KNOWS THE PROCESS.
UH, THIS, UH, MS. MALONE PROVIDED TO US.
I, YOU, YOU PROBABLY HAVE IT IN FRONT OF YOU.
I CAN'T, IT'S HARD TO SEE UP THERE.

SO YOU'RE GONNA TAKE THE ALL THE WAY DOWN TO THE DECKING OR TAKE THE DECKING OUT ALSO? WE'RE GONNA LOOK AT IT WHEN WE GET THERE AND OKAY.

OR, UM, I DON'T WANNA GET INTO HER FINANCING AND WHAT SHE'S DOING OR NOT.

ONE GREW INTO THE AIR CONDITIONING UNIT, SO THAT'LL PROBABLY NEED REPLACING.
UM, AND THEN EVERY FRIDAY I'VE GOT LISTED A MEETING WITH THE MS. MALONE TO GO OVER PROGRESS AND ANY LIKE FLOORING NEEDS TO BE PICKED OUT OR PAINT NEEDS TO BE PICKED OUT OR WHATEVER.
I MEAN, THE REST OF THIS IS GETTING MORE DEEPER INTO IT AS FAR AS THE ELECTRICAL BEING WORKED ON IN THE THIRD WEEK AND JUST CHECKED OUT REALLY, WE DON'T KNOW IF THERE'S ANYTHING WRONG WITH IT.
UM, INTERNAL WALL WORK BEING COMPLETED AND THEN PLUMBING CHECKED AND UPDATED AS NEEDED.
AND THEN THE FOURTH WEEK AGAIN, INTERNAL WALL WORK, FIFTH WEEK WOULD BE INTERNAL WALL WORK, STILL PAINTING AND WHATNOT.
AND THEN THE FOLLOWING WEEK WOULD BE FLOORING.
HVAC CHECKED AND REPLACED OR FIXED AS NEEDED.
FLOORING COMPLETED THE FOLLOWING WEEK, FLOORING FINISHED AND CABINETS INSTALLED THE FOLLOWING WEEK, PAINTING THAT SAME WEEK, APPLIANCE DELIVERED AND INSTALLED AND PAINTING IN THE LAST WEEK.
AND I DON'T NEED, UH, I DON'T MEAN TO BELABOR THE, UH, THE ISSUE, BUT YOU SAID YOU'RE GONNA START THE ROOF LIKE VERY SOON, RIGHT? MONDAY.
SO HOW LONG DO YOU ANTICIPATE IT TAKING YOU FOR TO REPLACE THE ROOF? IN NORMAL CIRCUMSTANCES, WE COULD STRIP THE ROOF AND REPLACE IT IN TWO DAYS.
BUT IF WE GET IN THERE AND THERE'S A LOT OF STUFF GOING ON, IT MAY TAKE ANOTHER DAY TO, TO FIX SOME WOOD.
