THIS NEXT ITEM IS A SITE PLAN FOR THE MDM TOWN HOMES. YOU CAN SEE THE PROPERTY IS OUTLINED IN YELLOW ON THE SCREEN. THE REQUEST IS FOR A SITE PLAN FOR A RESIDENTIAL TOWN HOME DEVELOPMENT. THEY'RE PROPOSING 36 UNITS ON ABOUT 3.1 ACRES. IT'S ZONE PLAN DEVELOPMENT, 37, AND IT'S WITHIN THE 360 CORRIDOR. THE SITE PLAN IS SHOWN ON THE SCREEN. AGAIN, THEY'RE PROPOSING 36 TOWN HOME UNITS. UH, THE PROPOSAL INCLUDES AN INTERNAL PRIVATE STREET GUEST. PARKING ACCESS IS OFF OF 360 FRONTAGE ROAD. THERE IS A SECOND POINT, WHICH IS EMERGENCY SLASH EXIT ONLY AND WILL BE GATED. THE HOA WILL BE REQUIRED TO MAINTAIN THE STREET COMMON AREAS AND THE SCREENING FENCE. THIS IS THE SITE PLAN ZOOMED IN A LITTLE CLOSER. SO PD 37 IS FOR SPECIAL COMPLEX USES. THEN IT DOES NOT SPECIFY MAXIMUM TOWN HOME DENSITY OR DEVELOPMENT STANDARDS. UH, THE PROJECT WAS EVALUATED AGAINST EVALUATED AGAINST THE SINGLE FAMILY TOWN HOME STANDARDS. UM, SO THEY ARE, UH, MEETING MANY OF THOSE REQUIREMENTS. UM, THE MAXIMUM DENSITY IS UNDER THE 3.2, WHICH IS ALLOWED FOR SINGLE FAMILY TOWN HOME ZONING DISTRICTS. UH, THE MINIMUM LIVING AREA IS AT 100% IN THE 1,150 TO 1,299 SQUARE FEET. IT'S AT 100% OF THE MINIMUM LOT AREA OF 1,680 TO 3,299. AND THEN THEIR MINIMUM LOT WIDTH IN DEPTH ARE ALSO 100% AT THAT, UH, LOWER RANGE. THEY'RE MEETING. THE OTHER DENSITY AND DIMENSIONAL REQUIREMENTS ON THE SCREEN IS THEIR PROPOSED LANDSCAPE PLAN. THEY'RE PROVIDING A THREE INCH CALIBER TREE IN FRONT OF EACH TOWN HOME. UH, TOTAL OF 30 GALLON OF SHRUBS SHALL BE REQUIRED FOR EACH LOT. UH, THEY ARE DEPICTING THE SHRUBS, BUT NOT THE AMOUNT. UM, THESE ARE THE PROPOSED BUILDING ELEVATIONS. THE UNITS ARE TWO STORY INCLUDES BRICK AND STUCCO, AND HAS OUR ARTICULATION AND THEN GLAZING. AND 2003, CITY COUNCIL APPROVED A SITE PLAN FOR A TOWN HOME DEVELOPMENT WITH 45 UNITS. THE CURRENT APPLICANT PURCHASED THE PROPERTY INTENDING TO DEVELOP THE PROPERTY CONSISTENT WITH THAT APPROVED, UH, SITE PLAN. UH, SITE PLANS EXPIRE AFTER FIVE YEARS IF NO PROGRESS HAS BEEN MADE TOWARDS CONSTRUCTION. AND SO THAT SITE PLAN FROM 2003 IS NO LONGER VALID. UH, IN 2021, THE APPLICANT SUBMITTED DEVELOPMENT PLANS TO PROCEED WITH THE DEVELOPMENT OF THE PROJECT. HOWEVER, SINCE THE SITE PLAN WAS NO LONGER VALID, WE REQUIRED THAT THEY REAPPLY FOR A NEW SITE PLAN. UH, SO SINCE 2022, THE APPLICANT HAS WORKED WITH STAFF TO MAKE CHANGES TO THE PROPOSAL TO BRING IT MORE IN LINE WITH CURRENT STANDARDS. UH, THE IMPROVED LAYOUT NOW INCLUDES PRIVATE INTERNAL STREETS THAT MEET THE STANDARDS OF EDC INSTEAD OF A FIRE LANE. A MORE TRADITIONAL TOWN HOME LAYOUT WITH BETTER INTERNAL CIRCULATION MEETS THE NEEDS OF THE SOLID WASTE DEPARTMENT. AND THEN THAT SECOND POINT OF ENTRY OFF OF 360 IS REQUIRED BY THE UDC. FOR DEVELOPMENTS WITH OVER 30 UNITS, UH, THE DEVELOPMENT REVIEW COMMITTEE RECOMMENDS APPROVAL WITH THE FOLLOWING CONDITIONS PRIOR TO THE ISSUANCE OF BUILDING PERMITS, THE APPLICANT SHALL REPL THE PROPERTY SO THAT THE LOT LINES AND PRIVATE STREETS ARE CONSISTENT WITH THE APPROVED SITE PLAN. UM, SECONDLY, I WOULD ENCOURAGE Y'ALL TO REMOVE THE HOA REQUIREMENT, UH, AT A TIME WHEN, UM, AFFORDABLE HOUSING AND IT IS AN ISSUE. THIS CREATES AN UNNECESSARY, UH, PRICE FLOOR. UH, PUTTING AN UPWARD PRESSURE ON THE PRICE OF, OF HOUSING. UM, YOU KNOW, BECAUSE NOT ONLY DOES SOMEONE NOW HAVE A MORTGAGE, THEY HAVE AN HOA PAYMENT. UH, SO I, I WOULD STRONGLY ENCOURAGE THAT ALSO FOR FUTURE DEVELOPMENT AT, AT SOME POINT IN TIME, MANY YEARS IN THE FUTURE, IF, UH, THERE'S A DE DEVELOPER THAT WANTS TO REDEVELOP THE LAND, HOAS, UH, MORE OFTEN THAN NOT GET IN THE WAY OF NECESSARY REDEVELOPMENT. SO THAT'S SOMETHING TO KEEP IN MIND MOVING FORWARD. UM, AND I THINK THANK, THAT'S IT. THAT'S MY THOUGHTS. I DON'T THINK WE HAVE, WE HAVE ANYTHING TO DO WITH THAT? CAN YOU SPEAK TO THAT RASHARD OR SAVANNAH? WELL, OUR, OUR UDC REQUIRES A HOA OR IT BE, UH, ASSESSED BY A PI, UM, MORE SO JUST FOR THE MAINTENANCE, LONG-TERM MAINTENANCE AND MAINTAIN, UM, VALUES IN THE AREA. IT'S ESSENTIALLY A CONTRACT. UH, SO, UM, THEY HAVE MORE POWER ACTUALLY, THAN THE CITY WOULD WITH REGARD TO REGULATIONS AND WHO, WHO ENFORCES THOSE REGULATIONS. OKAY. WE HAVE, WE HAVE A QUESTION. COMMISSIONER MADDEN. WELL, I JUST WANNA MAKE A COMMENT. SO IN, I DON'T KNOW WHAT YOUR EXPERIENCES WITH HOAS, BUT USUALLY THE, YOU KNOW, THEY'RE NOT, THEY'RE USUALLY QUARTERLY OR ANNUALLY DUE, LIKE MM-HMM . AND SO I DON'T THINK IT WOULD BE A SIGNIFICANT, OR LIKE SO INFLUENTIAL ON THE PAYMENT THAT IT WOULD KEEP SOMEBODY FROM PURCHASING THE PROPERTY JUST BECAUSE OF THE PRICE OF THE HOA LIKE MINE, UH, IN ONE HOME WAS, UM, A HUNDREDTH OF, UM, THE VALUE, THE TAX VALUE OF MY HOME AT THE TIME.
