NEXT ITEM ON THE AGENDA IS A HEARING CONCERNING DANGEROUS STRUCTURE LOCATED AT 1215 EAST MAIN STREET HERE IN GRAND PRAIRIE.WE'LL TURN IT OVER TO STAFF AT THIS TIME.
THIS IS, UH, A REVIEW, PRETTY MUCH OF COMING BACK 30 DAYS AFTER THE LAST MEETING WITH THE SAME, WITH THE SAME, UH, STRUCTURE.
UH, YOU'D ASK, UH, THIS WAS A REMINDER THAT THIS PROPERTY HAD THE, THE SUBSTANDARD DANGER STRUCTURE ON IT ON PART OF THE PROPERTY.
AND THE BACK HALF OF THE PROPERTY BACK PART OF THE PROPERTY WAS A, A CELL TOWER.
AND THE OWNER WAS INTERESTED IN, UH, RE PLATTING THE PROPERTY TO, UH, SELL THE FRONT PART THE, WITH THE BUILDING ON IT AND KEEP HIS CELL TOWER LEASE IN, IN PLAY.
UH, I THINK Y'ALL ASKED, I KNOW Y'ALL ASKED FOR TO SEE IF WITHIN 30 DAYS THEY HAD ACTUALLY WOULD APPLY TO HAVE THE REPL DONE.
WELL, THAT THEY HAVEN'T APPLIED WITH THE CITY, BUT THEY DID HIRE TWO WEEKS AGO, OR ON THE 30TH, A SURVEY COMPANY REPUTABLE, AND I TALKED TO 'EM TO DROP THE PLAT PLANS AND THE, FOR THAT TO PRESENT TO THE CITY, THE, THE, AND, AND THE, I COMMUNICATED WITH THE, UH, WITH THE SURVEYING COMPANY.
AND SHE SAID THAT, NO, WE'RE GOING TO HAVE THE LETTER PROPOSAL READY IN TWO WEEKS.
AND THAT WAS TWO WEEKS FROM A WEEK AGO.
UH, AND SINCE IN CONTACT WITH EVEN OUR PLANNING DEPARTMENT, UH, AND THE PLANNING DEPARTMENT GAVE THEM THE, THE, UH, TIMELINE ON ONCE IT'S APPLIED FOR, IF IT, THEY DON'T NEED VARIANCES.
IT'S ABOUT SIX WEEKS OUT IF A VARIANCE NEEDS TO BE APPLIED FOR IT'S EIGHT WEEKS OUT BEFORE THE REPLANT.
SO THAT'S THE PROGRESS ON THAT.
UH, AS FAR AS THE BUILDING GOES, I WAS THERE ON OCTOBER 30TH AND, AND SAW THE OWNER.
THEY HAVE CLEANED OUT AND I'VE GOT PICTURES TO SHOW YOU WHAT THEY'VE DONE.
THEY'VE HAULED OUT FOUR OR FIVE DUMPSTER LOADS OF STUFF OUT, OUT FROM INSIDE.
THEY HAD THE, I DON'T KNOW, THE, THE VINYL MATERIAL TO, TO REPAIR THE ROOF.
THEY WERE GONNA MAKE AN EMERGENCY REPAIR ON THE ROOF.
I HAVEN'T CONFIRMED THAT THEY'VE DONE THAT, BUT HE WAS GOING TO DO THAT THE NEXT DAY.
AND HE HAD THE STUFF RIGHT THERE.
I DON'T KNOW IF THEY'D HAVE DRIVEN OFF WITH THE TRAILER FULL OF STUFF WITHOUT DOING IT.
AND, UH, SO, AND THEN THEY HAVE MADE, WELL, THEY MADE IMPROVEMENTS ON GETTING THE PLACE CLEANED UP AND CLEANED OUT.
THE OWNER SAID HE HAD TALKED, HE DIDN'T KNOW NOW THAT IF HE REALLY WANTED

TO SELL THE PROPERTY, THIS IS FROM HIM, UH, BECAUSE THE, THE POTENTIAL BUYER WANTED TO, HE WANTED AHE SAYS, I'M JUST GONNA FIX THE BUILDING UP AND THEN SELL.
SO HE, HE SAID, GIVE ME TWO MONTHS AND I'LL HAVE IT FINISHED.
AND THAT, THAT WAS WHAT HE TOLD ME THEN.
I DON'T THINK HE'S HERE TONIGHT.
WELL, I KNOW HE IS NOT HERE TONIGHT.
UH, SO THIS IS THE REVIEW OF WHAT WE, WE DID.

AND THAT'S THE CONDITIONS THAT THEY WERE IN.

THOSE MANHOLE COVERS WERE OPEN.
THEY'VE SINCE BEEN COVERED UP.
SO THEN THIS, THIS IS, I TOOK THIS, THIS MO THIS AFTERNOON.
THAT'S THE FRONT, THAT'S THE BACK.
THEY FILLED THOSE DUMPSTERS UP AT LEAST TWO TIMES OVER AND HAULED THAT OFF.
AND THEY'RE THERE WITH MORE STUFF IN THEM.
THIS WAS OCTOBER 30TH WHEN I MET THE OWNER THERE.
I DIDN'T HAVE VERY GOOD LIGHTING, BUT THAT'S THE INTERIOR OF WHAT ALL THAT FURNITURE AND STUFF THAT WAS THERE BEFORE.
TAKING THE BAR DOWN THAT AREA BACK THERE IS LIKE WHERE THAT FURNITURE AND BEDROOM WAS.
THAT'S ANOTHER PART OF THE HOLE WAS STILL THERE THEN.
BUT THE MATERIAL WAS OUT FRONT.
SO THESE WERE OUR FINDINGS FROM, AND WE STILL FIND THE, THIS FINDINGS FROM THE LAST MEETING THEY STILL STAND TODAY, IS THAT IN ACCORDANCE WITH THE APPLICABLE LAW, THAT THE NOTICE OF THE HEARING WAS GIVEN TO THE OWNER LIEN HOLDER AND OTHER PARTIES WITH AN INTERESTED IN THE PARTY IN THE PROPERTY LOCATED AT 1215 EAST MAIN STREET, GRAND PRAIRIE, TEXAS.
THE PROPERTY, THE VACANT COMMERCIAL STRUCTURE LOCATED ON THE PROPERTY, UH, THE STRUCTURE IS DILAPIDATED.
PARTS OF THE WALLS AND CEILING PART OF THE ROOF IS MISSING.
THE STRUCTURE IS MISSING ELECTRICAL WIRING AND PLUMBING COMPONENTS.
THE STRUCTURE IS DANGEROUS, IS A DANGEROUS STRUCTURE THAT IS THE TERMED DEFINED IT AS A TERM IS DEFINED IN THE GRAND PRAIRIE CODE OF ORDINANCES, SECTION 29 28, 1, 2, 5, 6, 8, 9, 12, 13, 16, AND 17.
OUR ORDERS THEN OWNER SHALL ENSURE THE STRUCTURE IS REPAIRED, REMOVED, OR DEMOLISHED IN ACCORDANCE WITH APPLICABLE LAW WITHIN 30 DAYS OF THE DATE OF THIS ORDER.
OWNER SHALL KEEP THE STRUCTURE SECURE FROM ENTRY UNTIL THE STRUCTURE IS IN COMPLIANCE WITH THE APPLICABLE LAW.
ANY PERSON HAVING AN INTEREST IN THE STRUCTURE MAY REMOVE OR DEMOLISH THE STRUCTURE AT SUCH PERSON'S OWN RISK TO PREVENT THE ACQUIRING OF A LIEN AGAINST THE LAND UPON WHICH THE STRUCTURE STANDS.
SHOULD THE OWNER FAIL TO COMPLY WITH THE ORDER THE CITY HAS AUTHORIZED AT ITS DISCRETION TO REPAIR, REMOVE OR DEMOLISH THE STRUCTURE IN ANY ACCESSORY REQUIRED TO BE DEMOLISHED AT THE OWNER'S EXPENSE, OR IN THE ALTERNATIVE, ASSESS A CIVIL PENALTY IN THE AMOUNT OF $1,000 PER DAY FOR EACH DAY.
THE STRUCTURE CONTINUES TO BE IN VIOLATION.
ANY EXPENSE OWED TO THE CITY BY THE OWNER WILL BE BILLED TO THE OWNER.
FAILURE TO PAY THE CHARGES WILL RESULT IN A LIEN PLACED ON THE PROPERTY.
SUCH COST PENALTIES OR EXPENSES SHALL ACCRUE INTEREST AT A RATE OF 10% PER ANNUM.
THE CITY SHALL HAVE ALL REMEDIES PROVIDED BY LAW TO RECOVER MONEY OWED THE CITY, INCLUDING THE RIGHT TO PLACE THE LIEN ON THE PROPERTY.
UNLESS IT IS HOMESTEAD PROTECTED BY THE TEXAS CONSTITUTION, ANY SUBSEQUENT PURCHASER OF THE PROPERTY IS REQUIRED TO COMPLY WITH THIS ORDER.
