SO THE ZONE TEAM'S REQUEST IS TO, UM, THEY'RE, THEY HAVE AN EXISTING PD, WHICH IS P TWO 17.
THEY ARE ASKING TO ADD A DEFINITION FOR A PRIVATE CARD ROOM AS SHOWN HERE.
AND THEY'RE ASKING THAT USED TO BE ALLOW, UM, ADDED TO THE ALLOWABLE USES, BUT BY AN APPROVAL OF AN SUP.
SO IT'S NOT GONNA BE APPROVED BY RIGHT, UH, ALLOWED BY, RIGHT.
BUT IT WILL REQUIRE A SUP REQUEST.
SO WHAT WE'RE APPROVING IS JUST THE DEFINITION OF HOW THEY WANNA DEFINE THE PRIVATE CARD ROOM AND THAT CARD ROOM AS AN ALLOWABLE USE BY AN SUP.
SO WE NEED THE TWO STEP PROCESS.
SO YOU CAN EITHER APPROVE PD OR DENY THE PD AMENDMENT.
IF THE PD, UM, IF YOU RECOMMEND APPROVAL OF THE PD AMENDMENT, THEN WE CAN ALSO MAKE THE RECOMMENDATION FOR THE SUP TO BE EITHER APPROVED OR DENIED.
BUT IF YOU MAKE A RECOMMENDATION TO DENY THE PD AMENDMENT, THEN THE SUP CANNOT GO FORWARD 'CAUSE THE USE WOULD NOT BE ALLOWED.
THERE WAS ACTUALLY A SAME, UM, EXACT LOCATION, A SIMILAR APPLICATION BY A DIFFERENT COMPANY, DIFFERENT ENTITY WANTED TO DO A VERY SIMILAR USE HERE.
WHICH CITY COUNCIL DENIED BOTH PD AMENDMENT AND DSUP BACK IN FEBRUARY OF 2023.
SO THE PROPERTY OWNER HAS BEEN THE SAME SINCE THAT PROPOSAL.
UM, THIS TIME HAMILTON COMMERCIAL IS THE NEW APPLICANT THEY WANNA BRING FORTH THIS APPLICATION.
UM, THERE ARE IN A WAY SIMILAR IN THE REQUEST AS FAR AS THE PD AMENDMENT AND SUP REQUEST.
THERE ARE FEW MINOR CHANGES WHICH I'LL COVER DURING THE SUP REQUEST.
SO, UH, STAFF, UH, TAKES NO POSITION ON THE ZONE CHANGE, BUT NOTES THAT THE USE IS CONSISTENT WITH THE ENTERTAINMENT USES, UM, CURRENTLY PERMITTED IN THE PD TWO 17.

SO THE SUP REQUEST, IF THE PD IS AMENDMENT IS APPROVED, THEY ARE ASKING, THIS USED TO BE ALLOWED HERE AS PER THE APPLICANT'S OPERATIONAL PLANS AND THEIR PROPOSALS.
SO THEY ARE LOCATED AT 4 0 1 EAST PALACE PARKWAY.
THEY PLAN ON REMODELING THOSE AREAS.
SO ON THE FIRST FLOOR ACTUALLY THEY HAVE THIS GRAYED OUT AREA, WHICH IS, UM, THE EXISTING ENTERPRISE RENTALS.
THEY PLAN ON KEEPING THE TENANT THERE.
THEY HAVE LEFT, UM, THIS WHITE AREA ON THE BOTTOM RIGHT AS FUTURE USE.
SO THEY'LL BE HAVING THEIR FULL SERVICE KITCHEN AND CHECK AREA ON THE FIRST FLOOR.
SO HOW THEIR BUSINESS PLAN, HOW THEY, UM, PLAN ON MAKING PROFIT OFF OF THIS IS TO REQUIRE A MEMBERSHIP FOR ANYBODY WHO ENTERS THIS FACILITY.
THEY'LL BE ALSO CHARGED A SEAT RENTAL SO THAT THEY WILL BE CHARGED A HOURLY RATE OF HOW LONG THEY STAY WITHIN THIS ESTABLISHMENT TO PLAY THE GAMES.
AND THEY WILL ALSO BE SELLING FOOD AND DRINKS AND ALSO SOME MERCHANDISES.
AND THEY DO PLAN ON HAVING OCCASIONAL TOURNAMENTS WHERE, UM, MEMBERS WILL BE CHARGED AN ENTRY FEE AND A SEPARATE ADMINISTRATIVE FEES.
ON THE SECOND FLOOR, WE CAN KIND OF SEE MORE OF THE GAME AREA AND THE LOUNGE AREA.
SO AGAIN, THIS IS FOR A PRIVATE CARD ROOM.
THEY PLAN ON INITIALLY OPENING FROM 10:00 AM 10 IN THE MORNING TILL 2:00 AM AT NIGHT.
BUT AS THE BUSINESS GROWS, THEY PLAN TO EXPAND THE OPERATION HOUR HOURS TO 24 HOUR DAY OPERATION IN THE FUTURE.
SO ONE CHANGE FROM THE PREVIOUS APPLICANT IS, UM, THEY DO PLAN ON SERVING FULL SERVICE KITCHEN WITH THE FOOD AND DRINK SALES.
UM, THE PREVIOUS PEOPLE, A PREVIOUS APPLICANT, THEY WANTED TO DO BYOB.
THIS APPLICANT WANTS TO, UM, TRY WITH THE TABC TO SEE IF THEY CAN ACTUALLY OBTAIN THE PERMIT TO SELL THE ALCOHOL TO THEIR MEMBERS.
UM, SO FOR NOW WE'RE JUST LEAVING THAT DETERMINATION MORE TO THE TABC.
'CAUSE TABC WILL FIRST HAVE TO LOOK AT THEIR, UM, OPERATIONAL PLAN AND DETERMINE IF THERE ARE TRULY A PRIVATE CLUB WHICH CAN SET UP THEIR OWN RULES PER TABC REQUIREMENT OR IF IT'S A BUSINESS.
IN THAT CASE, IF THEY'RE NOT CONSIDERED A PRIVATE CLUB BY TABC, THEY'LL HAVE TO COMPLY WITH ALL OUR REGULATIONS AT THE CITY FOR ANY BUSINESSES THAT SELL ALCOHOL, WHICH MEANS THEY WILL HAVE TO SELL FOOD AND HAVE A FULL SERVICE KITCHEN.
SO WE'LL LEAVE THAT DETERMINATION FOR FIRST TABC TO TELL US HOW THEY WILL DEFINE THE APPLICATION TYPE OR THE PERMITTING TYPE FOR THE ALCOHOL AND SMOKING.
AND WE WILL CONSIDER THAT, UM, ALL MORE IN THE LATER IN THE PROCESS ONCE WE FIGURE THAT OUT BEFORE WE ISSUE THE CO.

THEY DO PLAN ON DOING A, A PATROL OF THE PARKING AREA AND ALSO, UH, TRANSFERRING SOME OF THEIR, UH, PATRONS TO THEIR CARS VIA THE PARKING LOT PATROL.
SO STAFF HAS A FEW RECOMMENDATION THAT WAS PART OF THE, UH, STAFF REPORT.
WE JUST CAPTURE THE FEW ONES THAT WERE IMPORTANT.
SO THE FIRST PART ON THE LEFT ARE ACTUALLY THE SAME RECOMMENDATION THAT CARRIED OVER FROM THE PD THAT WE ARE REPEATING, UH, FROM THE LAST YEAR'S RECOMMENDATION, WHICH IS THAT THEY PROVIDE LICENSED SECURITY ON SITE AND THEY PROVIDE SECURITY PROVISIONS SUCH AS HIGH RESOLUTION CAMERAS AND DROP SAFE AND ALARM SYSTEM.
AND THEN SUP MAY BE, UH, REVIEW MAY BE CONDUCTED IF THERE'S ANY CHANGES OF LAW INTERPRETATION.
THESE THREE CONDITIONS ARE KIND OF A NEW ONES THAT WE'RE ADDING DUE TO THE CHANGES PROPOSED BY THE APPLICANT, WHICH IS B-O-I-O-B TWO SELLING ALCOHOL AND UH, SMOKING.
THEY WANTED TO PROVIDE AN OUTDOOR SMOKING AREA.
SO ONE THING WE WANNA BRING TO YOUR ATTENTION IS THAT UM, THEY HAVE A MEMBERSHIP STRUCTURE OF ANNUAL MEMBERSHIP, MONTHLY MEMBERSHIP AND DAILY MEMBERSHIP.
STEPH RECOMMENDS A MINIMUM OF THREE MONTH MEMBERSHIP THINKING THAT THAT WILL TRULY EMPHASIZE THE MEMBERSHIP REQUIREMENT.
BECAUSE THIS IS A PRIVATE CLUB, WE FELT THAT IF IT WAS, UM, IF PEOPLE COULD UH, PURCHASE A DAILY ENTRY MEMBERSHIP, IT KIND OF DEFEATED THAT PURPOSE OF H HAVING A PRIVATE CLUB.
BUT THAT IS ONE OF THE CONDITIONS THAT, UM, THE APPLICANT WOULD LIKE TO REQUEST TO BE REMOVED.
SO WE'LL LEAVE THAT UP TO THE PNZ COUNSEL FOR DECISION.
UM, THE OTHER TWO IS RELATED TO THE SMOKING AND THE ALCOHOL SALES.
AGAIN, WE'RE DEFERRING THAT THIS IS BACK TO THE TABC AS THE APPLICANT HAS MENTIONED THEIR INTEREST IN PURSUING THOSE TABC ALCOHOL AND TOBACCO PERMIT BASED ON THE T DEFINITION OF THE PRIVATE CLUBS STAFF DOES NOT AGREE THAT THEY'LL MEET THAT CRITERIA BECAUSE TB IS VERY STRICT ON THE PRIVATE CLUB REGULATIONS.
BUT WE WILL LEAVE THAT UP TO THE APPLICANT TO FIGURE IT OUT WITH TABC AND BRING THOSE RESULTS BACK TO US.

SO IF THEY WERE TO PROVIDE AND SELL, I THOUGHT YOU SAID SOMETHING TO THE EFFECT OF LIKE, THE FOOD SALES WENT HAND IN HAND WITH THE ALCOHOL SALES.
SO THAT'S ACTUALLY PART OF OUR, UH, PERFORMANCE REQUIREMENT UNDER OUR UDC.
THAT IF IT'S A, UH, ESTABLISHMENT THAT IS OPEN TO GENERAL CUSTOMERS, THEY HAVE TO HAVE A FOOD COMPONENT.
WE REQUIRE THAT THEY BE, UH, LIKE A FULL SERVICE RESTAURANT WITH THE FULL SERVICE KITCHEN TO BE ABLE TO SELL ALCOHOL.
WE DON'T WANT LIKE A CIGAR BARS OR OTHER PLACES THAT ARE NOT REALLY SELLING FOOD TO BE ABLE TO SELL ALCOHOL.
'CAUSE IT'S REALLY HARD TO MANAGE THE PERCENTAGE OF ALCOHOL SALES AND ALL THAT.
SO THEY COULD DO BYOB AND THEN NOT BE REQUIRED TO PUT IN THE KITCHEN THAT WILL, I'LL HAVE TO CHECK WITH THE PUBLIC HEALTH.
I BELIEVE THAT IS THE CASE BECAUSE B-Y-O-B-I THINK THEY JUST HAVE THEIR OWN SEPARATE PERMITTING PROCESS THROUGH TABC.
SO THEY'RE NOT TECHNICALLY SUBJECT TO OUR RE REGULATION IS MY UNDERSTANDING, BUT I'LL DOUBLE CHECK WITH THE PUBLIC HEALTH.
SO THAT'S ONE THING WE HAVE TO KIND OF LEAVE IT OPEN BECAUSE THEY WANTED TO PURSUE LIKE A PRIVATE CLUB, BUT LIKE I SAID, TABC REQUIRES PRIVATE CLUB TO BE EITHER ON, YOU KNOW, UNINCORPORATED ASSOCIATION OF PEOPLES OR NON-PROFIT ORGANIZATION.

AGAIN, WE'RE JUST BRINGING FORTH WHAT THE APPLICANT WISHES AND THE CONDITIONS THAT WE CAN PUT ON AS PART OF THE, UH, POSSIBLE APPROVAL CONDITIONS.
